Terms of Service

These Terms govern your use of the Flicky mobile and desktop applications ("Flicky" or "the app"). By installing or using Flicky, you agree to these Terms. If you don't agree, please don't use the app.

1. The app

Flicky is a flashcard study tool with spaced repetition, shuffle, and quiz modes. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own non-commercial study and learning. All other rights are reserved.

2. Your content

You keep ownership of every deck and card you create or import. We don't claim any rights to your study content. Because Flicky stores your content locally on your device, you are responsible for backing it up if you want copies elsewhere.

You agree not to import content you don't have the right to use, and not to use Flicky to store unlawful material.

3. Sample decks and bundled content

Sample decks shipped with the app (e.g. Country Flags, World Capitals) are provided for convenience and may incorporate publicly available facts or third-party assets used under their respective licenses. They are provided "as is" with no warranty of accuracy.

4. Flicky Pro and purchases

Some features require a one-time or subscription in-app purchase ("Flicky Pro"). Purchases are processed by Apple's App Store or Google Play, and their terms govern the transaction, including:

• Pricing and currency — set per region by the platform store.
• Subscriptions — billing, renewal, and cancellation are managed in your App Store / Play Store account settings.
• Refunds — refund requests are handled by Apple or Google according to their policies. We are generally unable to issue refunds directly.

If you believe Pro features were not delivered after a successful purchase, email contact@d2vsolutions.com and we'll do our best to help.

5. Updates and availability

We may release updates that add, change, or remove features. We may also discontinue features or the app itself. We'll do our best to give notice in release notes when meaningful changes happen.

The app may be unavailable from time to time due to platform issues outside our control (App Store outages, OS bugs, etc.).

6. Acceptable use

Don't:

• Reverse-engineer, decompile, or attempt to extract the source of the app, except where applicable law expressly permits it.
• Use the app to violate the rights of others or any applicable law.
• Attempt to circumvent the in-app purchase mechanism or unlock paid features without a valid purchase.

7. Disclaimers

Flicky is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any data will be preserved without loss.

You are responsible for the choices you make based on what you study in Flicky. The app is a study aid, not professional advice.

8. Limitation of liability

To the maximum extent permitted by law, Flicky and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the app. Our total liability for any direct damages will not exceed the amount you paid for the app in the twelve months preceding the claim, or USD 20, whichever is greater.

Some jurisdictions don't allow the exclusion or limitation of certain damages — in those places, the above limits apply only to the extent permitted by law, and you may have additional rights.

9. App store terms

If you obtained Flicky through the Apple App Store or Google Play, you also agree to that store's terms. In the case of any conflict between those terms and these Terms with respect to the platform's role in delivering the app, the store's terms control as to that role.

Apple-specific acknowledgement: Apple is not a party to these Terms and is not responsible for the app or its content. To the extent these Terms provide any warranty that Apple cannot disclaim, Apple, and not Flicky, will be responsible for honoring it.

10. Termination

You can stop using Flicky at any time by deleting the app. We may suspend or terminate your license if you materially violate these Terms. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) will survive.

11. Changes

We may update these Terms from time to time. The "Effective" date above will reflect the latest version. Continued use of the app after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, except where mandatory local consumer-protection law gives you the right to bring a claim elsewhere.
